What is an Online Sportsbook in the USA?

Online sports betting was effectively legalized in 2018 with the Supreme Court striking down the Professional and Amateur Sports Protection Act (PASPA). Following this decision, states are now able to decide individually if and how sports gambling happens within their borders. 

While sports betting took place well before the overturn of PASPA in 2018, betting happened mainly in person at designated retail locations, often inside of casinos. Of course, bettors could participate in fantasy sports leagues and daily fantasy games before 2018, as they continue to do in the states where online sports betting remains illegal. Here’s a closer look at each state and its current rules regarding sports betting.

With not even a single casino operating within their borders, voters in the Cotton State have been reluctant to approve sports betting legislation. No serious proposals are currently on the table for sports betting.

Following the failure of a bill to legalize sports betting in May 2020, the Last Frontier State may well be the last frontier for US sports betting. Prior to this bill’s failure in May 2020, passage seemed possible with several Alaskan lawmakers showing support, including Governor Dunleavy. The state doesn’t even allow daily fantasy sports as the Alaskan State Legislature even considers DFS as gambling.

Voters in the Grand Canyon State passed legislation legalizing sports betting in September 2021. Home to one of the most passionate college sports fanbases in the country, voters in the Natural State pushed through legislation in February 2022. With market launch following just a few days later in March 2022, sports betting looked like it was ready to explode in Arkansas. 

That hasn’t been the case however due mainly to the rule which limits the amount of revenue sportsbooks may take outside of Arkansas. As of now, legislation in the state limits revenue leaving the state to a max of 50%. For this reason, you won’t find any of the major sportsbooks in Arkansas at the moment.

The state is looking at neighboring states of Maryland and New York as models, where online sports betting has blown up.

Sports betting legislation has been a real rollercoaster in the Sunshine State. Florida residents have witnessed a battle between state legislators, tribes, and gambling operators. The Supreme Court even stepped in, denying a request from Florida Casino giant West Flagler which sought to prevent the Seminole Tribe and Hard Rock from being the sole online betting operator in the state. Despite these legal tassels, sports betting has continued in the state though only through Hard Rock for the foreseeable future.

The Peach State has some of the strictest gambling laws in the country. Gamblers often cross into neighboring states as the state doesn’t allow horse racing, casinos, or sports betting within its borders. The sole option for gambling in Georgia is through the Georgia State Lottery. This is all despite numerous high-profile attempts to spark debate which may lead to legislation change surrounding sports betting. For now, these remain just discussions as there are no clear proposals on the table.

Daily fantasy and sports betting remains illegal in the Aloha State. Known for its conservative stance on gambling, Hawaii is one of just 2 states with no forms of legalized sports betting whatsoever. Despite several attempts to change this, no proposals have made it through as public opinion remains starkly opposed to gambling. The unique geographic situation of Hawaii not having any direct border states where gambling is legalized means that outside pressure to legalize is relatively minimal.

Gambling is limited in the Gem State where horse race betting, tribal casinos, and a state lottery encompass the current legal gambling options. For the time being, change seems unlikely as there haven’t been any serious proposals to change these rules. Bettors in Kentucky are able to wager in-person or online. It was legalized in March 2023, and retail sports betting was permitted from September of the same year. The options to wager in Kentucky are plentiful. 

Unlike most states, you only need to be 18 years old to bet on sports in Kentucky. However, certain sportsbooks require bettors to be 21 to sign up. You do not need to be a Kentucky resident to bet there, you simply need to be inside the state boundaries and of the appropriate age.

Louisiana was one of the first states to properly embrace sports betting. Retail sports betting began in October 2021, followed by mobile betting in January 2022. 

Bettors can choose from casinos, racetracks, and sportsbooks around the state. The Saints and Pelicans are the two professional franchises in Louisiana, while the Louisiana State University Tigers and Tulane Green Wave have considerable support, too.

eSports betting is not allowed at this point in time, and there are no online casinos. There has also been discussion about placing limits on the amount people can bet.

The Lawful Gaming Act enabled almost every online provider to apply for a license in Michigan. In-person betting was legalized in March 2020, and online gambling was permitted from January 2021.

There is currently no legal sports betting in Minnesota. Potential bettors will have to wait until at least 2025 for legislation after the stakeholders were unable to come to an agreement in 2024.

All 134 seats in the House are up for re-election in November, which could represent a significant change in Minnesota’s stance on sports betting.

One of the early movers in the sports betting space, Mississippi legalized in-person sports betting back in 2018. The process to permit online sportsbooks has been much slower, however, with bills for online and mobile betting getting stuck in the House and the Senate.

While mobile betting is technically legal in The Hospitality State, you can only place wagers while on casino grounds. Gambling of any type is only permitted inside casinos in Mississippi.

Locked in a legislative stalemate, sports betting is not currently legal in Missouri. Sportsbooks will not be permitted in Missouri until 2025 at the earliest, despite a poll showing that 38% of registered voters were in favor of legalizing sports betting. Just 35% were against it.

Efforts from a pro-betting coalition could see sports betting fast-tracked in Missouri, with the St. Louis Cardinals, Kansas City Chiefs, and other professional franchises pushing for legalization.

Given the state’s history with betting, it was hardly surprising when Montana approved legal sports gambling in May 2019. Various other forms of gambling had already been legalized.

Interestingly, online wagering is not permitted other than for horse racing, placing a major restriction on bettors in The Treasure State. Mobile sports betting apps can only be used while in licensed locations.

Sports betting was approved back in 2021, but changes to the law are slowing the process. As it stands, there are only two locations where bettors can legally wager on sports in Nebraska.

A third retail casino is due to open in Omaha. Reportedly, a coalition of sportsbooks decided against funding a petition to put online sports betting on the November ballot.

However you look at it, Nevada is the leader in sports betting in the US. Prior to PASPA being overturned in 2018, Nevada had been the hub of sports gambling since it became legal in the state in 1949.

Having hosted the NFL Draft and Super Bowl in recent years, Las Vegas has also added the Raiders, and will inevitably get an NBA franchise in the next half-decade. The Battle Born State remains at the forefront of sports betting, and there’s no reason for that to change any time soon. All the other states are simply trying to play catch up.

New Hampshire is one of a small group of states where you only have to be 18 years old to bet on sports. They also signed an exclusive deal with DraftKings due to a unique revenue proposal offering a 51-49 split.

DraftKings is the state’s lone online sportsbook. Bettors can place online wagers so long as they are inside the state borders, and there are in-person casinos in Dover, Manchester, and Seabrook. Several more locations have been authorized to build casinos. 

Bettors cannot wager on college games taking place in the state, nor can they wager on New Hampshire’s high school or college teams.

In-person and online sports betting are legal in New Jersey. There are currently 16 sportsbooks available, giving sports fans in The Garden State an excellent range to choose from.

New Mexico has unique, and slightly complex, sports betting laws. There has been no movement on sports betting legalization since PASPA was overturned in 2018, but it is still possible to wager on sports in New Mexico.

The Indian Gaming Regulatory Act of 1988 enables tribes to operate their own casinos, where sports betting is allowed. Several betting hubs allow wagers on horse racing, and northern residents can cross the border into Colorado, where sports betting is much more accessible.

Regulated by the New York State Gambling Commission, in-person sports betting has been permitted in New York since 2019. Online sports gambling was introduced in the first part of 2022. 

It is the biggest sports betting market in the country by handle, having regularly surpassed $1 billion per month. The nation’s premier sportsbooks are all fully licensed in New York. You don’t need to be a state resident to place wagers – you just need to be inside the state borders.

Sports Betting and Sportsbooks in North Carolina

In-person sports betting was legalized in 2019, but North Carolinians had to wait until 2023 for online sports wagering to be accessible. High-school sports are not eligible to be wagered on, though college and professional sports are fully accessible. The top sportsbooks are all licensed in North Carolina, including FanDuel, DraftKings, and BetMGM.

Efforts have been made by Roy Cooper to ban player prop betting on college games. A bill is yet to be passed, but the topic could resurface after the election.

Laws legalizing sports betting came into effect in North Dakota in 2021. Federally recognized tribes are allowed to offer sports gambling services on their lands, and several are already doing so.

Despite some specific laws in place for the recognized tribes, online sports betting will not be placed on ballots until November 2024 at the earliest. There are currently three sportsbooks operating in the Flickertail State.

The process to legalize sports betting in Ohio began in 2021. Online and retail sports gambling was permitted from the start of 2023. If you’re inside the state borders and over the age of 21, you have access to a whopping 19 sportsbooks.

Residents of The Buckeye State have taken to sports betting quicker than any other state. They were the fastest to reach a betting handle of $10 billion, taking just 16 months.

While sports betting is not yet legal in Oklahoma, it is in process. There are politicians keen to push through the legislation, and two bills were active during the 2024 legislative session. It will be interesting to see how this develops in the coming months and into 2025.

There was reportedly a sizeable gap between stakeholders when a bill failed in March 2023. As it stands, there are 143 tribal casinos in Oklahoma, and some daily fantasy sports contests are accessible in the state, although there is disagreement over the legality of these games.

Similar to New Hampshire, Oregon signed a deal with DraftKings. Sports betting was initially controlled by the Oregon Lottery after legalization in 2019, but the sports betting operation has been run by DraftKings since 2021. While the sportsbook options are limited compared to some other states, Oregon residents still have numerous promos to benefit from with DraftKings.

Online betting is not allowed on college sports in the Beaver State. There are four brick-and-mortar casinos where bettors can wager on college sports.

Sports Betting and Sportsbooks in Pennsylvania 

Governor Tom Wolf penned a gambling bill in 2017, allowing sports betting in Pennsylvania. Retail sportsbooks were accessible in November 2018, and they were followed by online sports betting platforms six months later.

Sports Betting and Sportsbooks in Rhode Island

Sports fans in Rhode Island have flexibility. They can bet online whenever they are inside state borders or they can head to one of the state’s two retail sportsbooks. If you’re more comfortable betting in person, head to Tiverton or Twin River Lincoln, both of which opened in 2018.

Quick to legalize sports betting, politicians quickly realized they were missing out on revenue, so they introduced online sports gambling a few months later. They produced their own sportsbook in partnership with William Hill. Initially, bettors had to register in person at one of the two casinos, but they backtracked on this and made it possible to register online so long as you are inside the state borders.

South Carolina currently does not allow sports betting. Bills have been proposed in 2019, 2021, 2022, and 2023, but there is yet to be any meaningful progress in legalizing gambling on sports in South Carolina.

A trip to North Carolina will allow you to place sports wagers, but there isn’t much hope for legalization in South Carolina at the moment.

South Dakota legalized sports betting in 2021, but there are some significant restrictions. You can only place wagers in person at sportsbooks or the state’s tribal casinos that offer sports gambling.

Efforts to introduce online sports betting are yet to get anywhere. Technically, you could use a sportsbook app, but it would only be legal when on casino premises. Nine of the state’s 11 sportsbooks are located in Deadwood, and the betting options will vary between them.

Tennessee has fully legal sports betting. Unlike most other states, though, you are not able to bet in person. Tennessee exclusively allows online sports betting at this time, which bucks the trend of states beginning with retail sportsbooks before moving online.

In May 2024, there was a 35% increase in Tennessee sports betting handles from 12 months ago. The industry is clearly booming, and residents of the Volunteer State have access to a catalog of tantalizing sports betting welcome offers.

Lobbyists and politicians have been battling over sports gambling for several years. A whole-hearted effort in 2023 did not make any meaningful progress, despite the backing of former Dallas Mavericks owner Mark Cuban. With a population of over 30 million and several well-supported sports teams, there is a massive upside for sports betting in the Lone Star State.

A January 2023 poll showed voters are largely in favor of sports betting, which could give hope to Texas residents. The Astros, Dynamo, and Frisco Fighters all signed sportsbook partnerships in 2022.

With deep ties to the Mormon faith, any form of gambling is illegal in Utah. It is one of five states without a state lottery, and it’s very unlikely sports betting will be legal in Utah any time soon.

Opposition to gambling is so strong that the state’s criminal code explicitly mentions they will not legalize gambling even if there’s a change to federal law. However, daily fantasy sports and social sportsbooks are not outlawed at this stage.

Sports betting launched in Vermont in January 2024. FanDuel, Fanatics, and DraftKings are the state’s three legal sportsbooks at the time of writing. Like Tennessee, online sports betting is the only option if you are inside state borders at the moment.

In-state college teams cannot be wagered on unless they are involved in a tournament. After the decision was made, the scoring system to decide on the licensed sportsbooks was made public, with financial stability, responsible gambling, and software all valued highly.

Launched in 2021, Virginia enabled in-person sports betting and online wagering. Cities needed to have referenda before committing to brick-and-mortar locations, and four decided to go ahead.

Bettors can place sports wagers in Washington State. Online bets are allowed, but you must be located in a casino to use their accompanying app. It is currently only legalized on plots of land belonging to federally recognized Native American tribes.
